THINKING ABOUT BRINGING A REPORTER TO JAPAN?

Be sure they can answer yes to all of the following questions:

  • Can they cover the depositions without your law firm obtaining deposition visas for them?

  • Can they assist you in the deposition visa process?

  • Will they cover the depositions without charging airfare, hotel, meals, taxis and other travel expenses?

  • Will they cover the job without charging you for travel days and weekends?

  • Do they follow the Federal Rules of Civil Procedure guidelines for transcript formats?

  • Are they certified by NCRA (National Court Reporters Association) in the
    U.S.?

  • Are they able to realtime technical matter with 99.5% accuracy or better, including Japanese proper names and geographical terms?

  • Are they sure their equipment will arrive intact and on time in light of increased airport security and weight restrictions?

  • Do they specialize in realtiming complex intellectual property cases?

  • Do they have a physical office location in Japan?

  • Do they have support staff in Japan?

  • Will they use American spellings (criticize, analog, recognize, defense) and
    not British spellings (criticise, analogue, recognise, defence) which can
    complicate spell check and word index and word search capability?

  • Is the agency sending a reporter that actually works in their office as opposed to subcontracting it to an outside reporter they hardly know?

  • Can they act as a liaison with the Embassy/Consulate when you are having difficulty getting a response from them via telephone?

  • Can they produce printed, certified transcripts in Japan if requested?

  • Do they have a backup plan if any of their equipment malfunctions?

  • Are they bringing multiple laptops to the depositions for attorneys who have connectivity problems in Japan?

  • Can they provide laptops to the interpreters to facilitate a smooth-flowing deposition?
